Terms of Service

These Terms of Service (“these Terms”) set out the conditions under which O-Lab LLC (“we”, “us” or “our”) provides the app “Gravity Swing” (“the App”), and the rights and obligations between us and users regarding its use. By using the App, you are deemed to have agreed to these Terms.

This is an English translation of the Japanese original. If there is any difference between the two, the Japanese version prevails.

Article 1 (Scope)

  1. These Terms apply to all use of the App.
  2. Any individual rules or guidelines we post in the App also form part of these Terms. Where an individual rule differs from these Terms, the individual rule prevails.

Article 2 (What the App is)

  1. The App is a physics puzzle game in which you read how a probe's path bends under the gravity of planets and guide it to the goal.
  2. The App includes features that let users make and save their own stages.
  3. The App shows video ads as one way to get more tries. Watching them is optional. The content of ads is decided by the ad network, and we are not responsible for it.
  4. In-game points, tries, tuner shots and similar (“in-game data”) can be used only within the App, have no monetary value, and cannot be exchanged for cash or anything else, or refunded.

Article 3 (What you need to use the App)

  1. You are responsible for providing, at your own cost, the devices, network connection, power and anything else needed to use the App.
  2. How user information is handled is set out separately in our Privacy Policy.

Article 4 (Prohibited conduct)

When using the App, you must not:

  1. Break the law or act against public order and morals
  2. Analyse or modify the App, or tamper with in-game data by improper means
  3. Improperly manipulate, or place an excessive load on, the App or our servers or network
  4. Infringe the rights or interests of other users, third parties or us
  5. Include personal information (your own or anyone else's, such as a real name, address or contact details) in your display name, profile image, stage names or similar
  6. Include in your display name, profile image, stage names or similar anything against public order and morals, defamation, discriminatory expressions, obscene or violent content, advertising or solicitation, content that infringes the rights of third parties, or anything else that causes trouble for other users
  7. Impersonate someone else
  8. Do anything else we consider inappropriate

Article 5 (User ID and game data)

  1. To identify users, the App automatically creates an anonymous account at launch and issues a user ID. The user ID is stored on the servers of Firebase (Google LLC), which we use.
  2. If you do not link an account, your game data is stored only on your device. It will be lost if you change or reset your device or delete the App, and we cannot recover it.
  3. By linking a Google account or Apple ID, you can carry your user ID, display name, profile image, game progress, records, the stages you made and the stages you received over to a new device. Linking is optional.
  4. To show them in the ranking, your display name, best score, number of stages cleared and profile image are sent to our servers and shown to all other users. Do not put anything you would rather keep private in your display name or profile image. Both are optional, and you can change or remove them at any time.
  5. You can delete your data at any time from “Settings → Account → Delete account and all data” in the App. Deleted data cannot be recovered.

Article 5-2 (Reporting and removing inappropriate content)

  1. If you find another user's display name or profile image in the ranking that breaks Article 4, please email gravity@o-lab.co.jp with the subject “Report” and tell us the display name in question.
  2. When we receive a report, or when we ourselves judge content to be inappropriate, we may remove the display name, profile image, stage name or similar without notice, or suspend that user's use of the App.
  3. We are not obliged to investigate reports, and we decide whether and how to act.

Article 6 (Stages made by users)

  1. You guarantee that you have the legitimate right to create any stage you make in the App (“your stages”).
  2. When you hand one of your stages to another user, its content and name go to the person who receives it. It carries no information about who made it.
  3. A stage cannot be edited once it has been finalized. To change it, duplicate it and remake it as a separate stage.
  4. The rights to your stages belong to you. However, we may use your stages free of charge (display, copy, store and so on) to the extent needed to provide and operate the App.
  5. Any dispute arising from your stages is to be resolved at your own responsibility and cost, and we are not liable unless we acted intentionally or with gross negligence.

Article 7 (In-app purchases)

  1. The App sells paid digital content (extra tuner shots, unlimited tries and similar).
  2. Purchases are made through the payment methods of your store (the App Store on iPhone, Google Play on Android) and are complete when the purchase process finishes. Because this is digital content, returns and cancellations cannot be accepted after purchase. For details, see the Commercial Transactions Notice.
  3. Purchased content can be used only within the device and store account used to buy it.
  4. If you are a minor, please obtain the consent of your legal representative (parent or guardian) before purchasing.

Article 8 (Intellectual property)

  1. The intellectual property rights in the App and its programs, images, text and so on belong to us or to their rightful owners.
  2. The App uses content provided by the third parties below. Each is subject to the terms of use set by its provider.

Fonts
The App uses the following fonts, provided under the SIL Open Font License 1.1.
Orbitron (Matt McInerney) / M PLUS 1 (The M+ FONTS Project Authors) / Share Tech Mono (Ralph Levien)

In-app purchases (App Store / Google Play)
The App uses Apple's App Store on iPhone and Google Play billing on Android for in-app purchases.

Authentication and data storage (Google Firebase)
The App uses Google's Firebase (Authentication / Cloud Firestore) to identify users and to provide account linking. Account linking uses a Google account or Apple's Sign in with Apple.

Ads (Google AdMob)
The App uses Google AdMob to serve video ads. For how your advertising ID is handled, see Article 9 of our separate Privacy Policy.

Article 9 (Changes, suspension and termination of the service)

  1. We may change, add to, suspend or end the App without notifying users in advance.
  2. We are not liable for any loss users suffer as a result of measures taken under this Article.

Article 10 (Disclaimer)

  1. The App is provided as it is available at the time, and we make no guarantee of its accuracy, completeness, usefulness, fitness for a particular purpose, or freedom from errors or defects.
  2. We are not liable for any loss suffered by users or third parties arising from the use of the App, unless caused by our intent or gross negligence.
  3. In-game data may be lost through device failure, data loss, changes to the App and so on, and we do not compensate for such loss.

Article 11 (Changes to these Terms)

We may change these Terms without notice to users when we consider it necessary. If you use the App after a change, you are deemed to have agreed to the changed Terms.

Article 12 (Governing law and jurisdiction)

These Terms are governed by and interpreted under the laws of Japan. Any dispute concerning the App is subject to the exclusive jurisdiction, in the first instance, of the court with jurisdiction over our place of business.
